The Code of Spatial Planning, Urbanism and Construction (Law 169/2026) was published in the Official Gazette no. 661 of 10 August 2026. For an energy auditor, the part with the most direct consequences is professional civil liability insurance.

What the Code requires

Art. 556 para. (2) requires RCP insurance from all technically and professionally attested or authorised specialists. Its absence is a contravention, and the right to practise may be suspended for 9 months (art. 572 para. (2) lit. b)).

Since when it applies

The Code enters into force 15 days after publication, that is from 25 August 2026 (art. 575 para. (1)). Art. 575 para. (2) says that its application is not conditional on the adoption of secondary or tertiary legislation: a rule that is late does not postpone the obligations in the Code.

Energy certification stays under Law 372/2005

Art. 402 para. (2) still refers to Law 372/2005 for the energy performance requirements of buildings. The Code does not rewrite certification; it changes the liability framework around it.
